Americans have been faced with this same issue in previous centuries, “in 1890, an orphan from New York City who had been physically and emotionally abused, shot two other boys to death while they slept in a Union Pacific boxcar crossing into the new state of Wyoming. ... ”[New York Times] This brings up the point of the level of maturity and psychological development of a minor convicted of murder, “Studies by the MacArthur Foundation’s Research Network on Adolescent Development and Juvenile Justice are finding that the cognitive, emotional and social development of adolescents is incomplete, and that boys well into their late teens have difficulty curbing their impulses, thinking through long-term consequences and most relevant to Lee Malvo, resisting the influence of others. ... To the other side it is quiet simple, a juvenile who gathers enough courage and hate enough to be able to kill his fellow human, should be allowed to pay for such a manly crime by a manly punishment. ... When it comes to murder, however, many people believe juveniles should be punished as adults-even if that means death. ... ” [DPIC] Most people can agree that human beings are not equip and sincere enough to make such a major decision as life and death but in addition to that other outside forces make the process inaccurate, “ Thanks in part to DNA testing, we now know about the faults in the system. ... “race plays a powerful and insidious role in meting out death sentences.
