Court Report
The Australian adversarial system is a system of trial which aim is to allow everyone a fair say, a chance to present his or her case. In this system the judge, jury, and the legal representatives of the parties involved have definitive roles. The people in each of these positions must fulfill their respective roles to ensure that a neutral court is available to resolve any dispute. Through extensive research the following was found: That the Australian Adversarial system is a success and Justice is found is most cases. The following informs about different roles that are involved in the system, an observation of a court trial and a summary of the adversarial system and what the judge/ magistrate does to give the jury a better understanding of the cases.
Research Methods
Primary source was used on observation of the court room and the Adversarial system at Brisbane courts.
Secondary sources were by reading and evaluating from books, notes, using internet sites and reading articles on the cases and the adversarial system.
Roles and Protocols
Judge/ magistrate: The judge wears a robe and a wig and controls what happens in the courtroom. He is addressed as 'your honour' and also decides on the matter of the law. Everyone is required to bowl to the judge as he enters the court room and when he enters and leaves...
