This paper will discuss the proper process that John will take to file a discrimination complaint against his employer. Also, it will discuss the time frame to filing a complaint.
The first step that John needs to do is to file a discrimination complaint against his employer. He must first contact the Equal Employment Opportunity Counselor (EEOC) within 45 days of the incident. John's complaint must identify the action, decision, conduct, or other basis that constituted an alleged act. The complaint must also allege that the action, decision, or occurrence was taken or based on the complainant's race, color, religion, sex, sexual orientation, national origin, citizenship, age (over 40), disability, Vietnam-era veteran status, or other unlawful discriminatory grounds.
John has a chose to have counseling; it must be within 90 days. "If the matter is not resolved in that time period, they must inform the employer that a complaint has been filed.
