Judicial Review
Judicial review of the constitutionality of laws as it exists today in the United States is flawed and against the principles of good democracy. Having the Supreme Court exercise the duty of judicial review may be the system that the United States has at this moment, but it is most certainly not the right one. ... Also, because of the life tenure, the position of justice has become politicized to the point where the court can do near anything, because there is no real check on its power of judicial review. The process of judicial review, while essential to the constitution, needs to be changed because the people who perform it are not elected, life tenure allows the court to impede the progress of an elected majority, and the court has no real check on its power, allowing the political majority in the court reign supreme over the constitution. ... Unfortunately for the voters, the judges who perform the function of judicial review do not have such an obligation. ... In fact, the other branches of the government do not have much power to offset judicial tyranny; while the people have no power whatsoever.
