PJ Schaefer Mod 4 3/18/03 New York Times v. United States United States v. Washington Post Company 403 U.S. 713, 91 S. Ct. 2140, 29 L. Ed. 2d 822, June 30, 1971 Facts: The Pentagon had started a think tank along with the Rand Corporation. The think tanks job was to do a thorough history of United States policy relating to Vietnam. The result was a top secret 47 volume study entitled History of U.S. Decision Making Process on Vietnam Policy. Daniel Ellsberg was assigned to the think tank. He was for the war before this project but the documents changed his view so much that afterwards he was against it. Ellsberg took eighteen of the volumes out of the files of the Rand Corporation, and photocopied them, and returned them. All of the files were marked Top Secret. Ellsberg and the man who helped him Russo turned the photocopied material over to the New York Times.
