Please note, after receiving the coursework I am posed with the following question, what are the advantages & disadvantages of the New Engineering Contract (NEC)? I have interpreted the meaning of this question as requiring discussion with regard to the ‘ethos’ of the NEC and not the actual organisation, structural mechanisms of the NEC, as that I feel, would require an essay far in excess of the permitted 1,500 words.
New Engineering Contract
If we are to consider the advantages and disadvantages of the NEC family of contracts, I believe we must first put the question into context, by considering what is a contract and secondly, how does The NEC contracts compare with other contracts within our construction Industry.
Most dictionaries state similar versions of the following: – ‘Contract- a binding agreement between two or more persons or parties. ... Firstly this contract can be traced back as a (Broome & Hayes, 1997) ‘direct descendant of the original RIBA form first published in 1870’ which many commentators’ believe, accounts for its ‘adversarial nature’ and many ‘redundant legal phrases. ...
Various interested parties of the Construction Industry, formed JCT contract in 1960, yet as early as 1967, even legal representatives were calling for ‘revolutionary’ reform of the Contract. ...
Despite the many idiosyncrasies of the JCT contract, as stated, it is the market leader and always has been. ... ’ In addition, demands for adoption of procurement practises as:-

· Partnering
· Supply Chain Management
· New technology and techniques
Furthermore, the Latham Report called upon the New Engineering Contract (NEC) to adopted as the Industry Standard Form of Contract. The Institute of Civil Engineers (ICE) first produced the NEC in 1991.
