Does Crocker have the right to sue? Yes. Was the company liable? This question poses many arguments. However, I believe Kamikazi Ski Lodge is not liable for the injuries that incurred to Crocker.
Kamikazi did owe a duty of care. Crocker should have seen that his actions would cause harm. However, since Crocker could not anticipate all the possible consequences of his actions, Kamikazi had to think, if a reasonable and alert person could have foreseen Crocker's conduct would likely cause harm. They did not breach their duty, but rather their duty was induced by a spectator and therefore the contract was breached.
Was Kamikazi at fault?..
