Juveniles who commit murder
Can we really try the youth of America or juveniles as adults in a society that has failed
them as children? ... That
is a horrible situation to be sure, but is it murder? For an act to be murder you need pre
meditation, deliberation, and malice. ... I will discuss the reasons why juveniles who commit murder should NOT be tried as
adults. We need to take into consideration the aspects of gun control, the foundation of family
morals and how it plays a role on the juveniles behavior patterns. ... But, the child cant, so we don’t have murder. We don’t have two of the
fundamental components necessary to charge an individual with first degree murder.
Only 13% of the violent crimes in the US were committed by juveniles. ... That is to say that they did not plan
the murder. ... He was
executed in 1989, he was 17 years old at the time of the murder of a police officer in 1977. ...
Incarcerating juvenile in adult jails places the juveniles in real danger. Research
demonstrates that children in adult institutions are 5 times more likely to be sexually assaulted,
twice as likely to be beaten by staff, and 50% more likely to be attacked with a weapon than
juveniles confined in a juvenile facility. Similar statistics studied of juvenile offenders being
tried as adults suggests that juveniles sentenced as adults to adult prisons, revert to a life of crime
more quickly after they were released, and committed more crimes and more serious crimes, than
those in juvenile institutions. ... Instead of concentrating on prosecuting
juveniles in adult jails, what ever happened to Prevention? ... From my research, I found that some 65% of all juveniles that are committed of
violent crime have at some point of another have tried to end their own lives. ... We have touched upon
the underlying problems that are taking place in juveniles offenders lives. ... Obviously a strong family foundation is needed in every
young adults live, and instead of state facilities, rehab is the best measure to take to prevent the
juveniles from going back to their old ways.
