Legal Process
According to the information found on their website, "The Equal Employment Opportunity Commission (EEOC), an independent federal agency was created by Congress in 1964. The mission of this agency was to eradicate discrimination in employment. EEOC has authority to receive, initiate and investigate charges of discrimination filed against employers who have a statutory minimum number of employees. Their role is to also investigate whether the charge allegations are fair and accurate." The following is a recap of the claims process found on this website. They pertain to the steps that are taken when charges have been filed with this agency:
1) The employer is notified that a charge of discrimination has been filed against them. The EEOC's responsibility is to investigate and determine whether there is a reasonable cause for the charge. Therefore an investigator will be assigned to the case and their name and contact information will be disclosed to the employer.
2) The employer has the option to resolve the charge through Mediation or Settlement which are voluntary resolutions. Early in the process, the investigator will advise the employer if the charge is eligible for Mediation...
