FACTS
Gallery dealers of Thomas Kinkade artwork, that have signed contracts with Media Arts, filed suit against Media Arts and others, stating that the defendants unfairly sold artwork to the public at discounted prices "while requiring the Gallery Owners to sell at inflated prices" (Media, slip op. at 3).
LOWER COURTS
Honorable Susan E. Criss denied Media Arts' motion to stay the suit and compel arbitration (Bay 2003). The 212th district court denied this motion partially based upon the favorable decision that the some dealer agreements did not include an arbitration agreement (Bay 2003). Consequently, the dealers contend that they did not agree to arbitration and therefore can not be forced to do so. Media Arts sought a Writ of Mandamus to compel arbitration...
