Thomas Hobbes is first a positive law philosopher and, secondly, a divine law philosopher. Hobbes believes in democracy; that the common people are the core government. Most of Hobbes' theories are relative to Canadian law and parallel to modern concepts.
Thomas Hobbes believes that there should be laws produced by man. Hobbes states, "that the opinions men have of the rewards and punishments which are to follow their actions, are the causes that make and govern the will to those actions." (The Elements of Law Natural and Politic) The opinions that men have help to set limits, punishments or rewards to the actions of the public. This determines the criteria and jurisprudence behind a law. Canadian laws are determined by the opinions and views of the people. They are based upon the beliefs of the majority and are designed to compromise these beliefs.
