While Spendbig Credit Services is a multinational company, following the guidelines set forth by the government is essential to ensure that the practice of subsequent laws is both proper and consistent. Therefore, in response to your request we have prepared the following detailed analysis and legal recommendations regarding Spendbig Credit Service's legal obligations in specific situations the company is currently facing. These recommendations are based on the facts provided and corresponding Labor, Civil Rights, Employment, and Privacy laws.
SITUATION NO. 1 FRANKLIN COFFEE AND HIS SICK MOM
Franklin Coffee has requested time off for 3-4 weeks while he makes arrangements for the placement of his sick mother, puts her financial affairs in order, and gets her house in shape for sale by a realtor. The company may be obligated under the Family and Medical Leave Act of 1993 to allow Franklin up to 12 weeks of job-protected, unpaid leave.
WHAT IS FMLA?
The Family and Medical Leave Act (FMLA) allows employees to balance their work and family responsibilities by taking unpaid leave for certain reasons. The Act is intended to promote the stability and economic security of families as well as the Nation's interest in preserving the integrity of families. The following reasons are acceptable for protected, unpaid leave under the FMLA:
Birth and care of the employee's child, or placement for adoption or foster care of a child with the employee;
Care of an immediate family member (spouse, child, parent) who has a serious health condition; or
Care of the employee's own serious health condition...
