The hypothesis that the sporting arena is simply a place to let off steam and the statement, "the law destroys the passion of the game" is totally incorrect. This essay will talk about why it is incorrect and about other issues affecting the sport and law.
By participating in a game, a player impliedly consents to those actions that are inherent to the game. However the player does not consent to those actions against him or her which are not within the recognised and reasonable rules of the game. That is why law, which in sport is governed by tribunals, must continue to protect players and punish those players who play outside of the recognised rules of the game.
The law of negligence is another reason why sport needs law and tribunals. On the sporting field all players are your legal neighbour, therefore you owe a legal responsibility to them not to play outside the rules of the game. Failure to do so could result in an injury to another player. Players do not generally consent to actions outside the rules of the game. For example, head high tackles are not actions that players have consented to by playing the game and so may give rise to an action in negligence...
