Mail or Telephone Order Merchandise Rule
When shopping online, ordering by phone, ordering by fax or by mail there are certain rules that the seller must follow in order for the sale to be legal. The '30-day Rule' applies to all the sales listed above. On the date that the customer fulfils the order, the seller then has 30-days to ship the item(s). If for some reason the seller cannot meet the shipping date, it is their obligation to make arrangements with the customer. If at the time the customer is unavailable to contact or denies shipping delay, a full refund must be given.
A seller must have reasonable basis before offering to sell their merchandise. "Reasonable basis means that the merchant has at the time of making representation, such information as would under the circumstances satisfy a reasonable and prudent businessperson, acting in good faith, that the representation is true." If the seller knows they cannot fulfill the required shipping date at the time of sale, they must make arrangements then to ship at a later date; but once again the customer must agree to these terms or full refund is required.
