Health and Safety Within the Context of Care Services
There are many legislation which are relevant to health and safety within the care settings. These legislation include the following:-
Health and Safety at Work Act 1974
Management of Health and Safety at Work Act 1994
The Care Standards Act 2000
The main legislation is the Health and Safety at Work Act 1974. This was amended in 1994 and also renamed to the Management of Health and Safety at Work 1994, this was to add the employers/managers responsibilities and risk assessments. The Health and Safety at Work Act 1974 was set up for a more flexible and workable alternative from the other legislation that were in place before hand.
The legal regulations which should be in place within any care setting, because of health and safety are as follows. Health and Safety Regulations (first Aid) 1981 states that there must be one first aider for every 50 employees. If there is less than 50 employees, the employer must assess the needs for specific first aid training according to the care setting.
There must be appropriate first aid equipment within the building, and first aid boxes must contain guidance cards, individually wrapped plasters, sterile eye pads, sterile dressings, safety pins, triangular bandages, disposable gloves and sterile water ( if no tap nearby). Health and Safety Regulations 1981 also states that official records must be kept of any incidents which occur within the care setting.
