“Laws are based on individual and community values. This is true for Australian and for
Customary law.”
Laws are not based on the values individuals hold because values vary so much among individuals.
Further, some individuals might hold values that reflect extreme views on things. In addition, the
process by which laws are made does not cater to individuals and no one individual makes up the law.
Laws are made through parliament. They reflect the will of parliament, and therefore the community -
even though individuals take part in debates. Laws are also made by judges but judges are bound by
precedent; by laws developed over the centuries. They extend and develop these laws according to
changes in the community’s attitudes toward things; not according to any particular individual’s
attitudes.
