Nebraska tried to pass a state law banning partial-birth abortions, however the Supreme Court struck it down because they believed that it didn’t make exceptions for the mother’s health and because it didn’t define the process clearly enough. However, following is the revisions in the law, and it does seem to clearly define the procedure:
“Partial-birth abortion means an abortion procedure in which the person performing the abortion partially delivers vaginally a living unborn child before killing the unborn child and completing the delivery. ... The law states that a partial birth abortion shouldn’t be performed “unless such procedure is necessary to save the life of the mother whose life is endangered by a physical disorder, physical illness, or physical injury, including a life-endangering physical condition caused by or arising from the pregnancy itself” (“Brief of the Attorney General”, 2000).
The most current problem about abortion today is President Bush’s recent decision to sign the bill that bans partial-birth abortions. This bill defines partial-birth abortions as a procedure “‘in which a physician delivers an unborn child’s body until only the head remains inside the womb, punctures the back of the child’s skull with a sharp instrument and sucks the child’s brains out before completing delivery of the dead infant’” (qtd. ... This bill has caused many people to fear that women’s access to abortions will be rolled back for the first time in thirty years. What this bill is aiming to ban are some of the procedures used in second and third trimester abortions, and trying to outlaw “‘deliberately and intentionally vaginally [delivering] a living fetus. ... Although the bill has been signed into law, the American Civil Liberties Union is concerned because they claim that ‘partial-birth’ abortion is not really any particular abortion procedure (Korcok, 2003). ... Many people wonder if, during partial-birth abortions, the fetus feels pain. ...
In 1996, after the partial-birth abortion ban act was introduced, many abortion advocates had trouble with the term ‘partial-birth’. ... Partial-birth abortion is believed to be only done because it is convenient for the abortionist. ... Also, many newborns are exposed to local anesthesia during labor and delivery, and at birth they can not be differentiated from newborns who weren’t exposed to anesthesia. ... All of these preterm babies were at the same age that some fetuses are considered for partial-birth abortions. ...
The partial-birth abortion is a very graphic procedure. ... He inserted forceps and pulled the baby down by it s legs into the birth canal, and then delivered the whole body except for the head. ... Late-term abortions are difficult to decide upon because there is probably already an attachment to the baby, through such ways like dreams, plans, and hopes. ... More recently studies have shown that after abortions, women feel guilty, but weren’t pathological. ... Avoidance and denial caused poor adjustment after having the abortions (Suffla, 1997). ...
Research Proposal
This proposed project will be done in order to figure out how some women are dealing with their partial-birth abortions. ... My theoretical perspective is also that partial-birth abortion is not an acceptable form of abortion and that it is not necessary, even if the mother’s life is in danger, because there are other forms of abortion that can help her. By also banning partial-birth abortions it doesn’t necessarily mean that no abortion procedures will be available to women in their third trimester. It has been said that partial-birth abortions are unnecessary and are only convenient to the abortionist. ... In order to collect data I would do an open ended interview with the women who were to receive partial-birth abortions before, after, and then one year later after the procedure. ... I would let them know that this project is strictly to find out their feelings and to let other women know some of the emotions involved in abortions, and it’s not about their personal identities. ... Also, if only a few women are interviewed the results might not be representative of women who get partial-birth abortions as a whole.
