A) 1) FACTS- The case of Young V. Montgomery was brought to the United States District Court for the middle district of Alabama, Northern Division, on February 23,1995. James Young, Derrick Williams, and Rutland Smiley sued the Montgomery County Board of Education. The plaintiffs sued that policy IDFA discriminates against black students in Montgomery county in violation of the Equal Protection of the fourteenth amendment of the United States Constitution, Title 7 VI of the Civil Rights act of 1964, and the regulations promulagated under Title 7. Young, Williams, and Smiley were all black athletes who wanted to transfer from a prodominantly black west side school in Montgomery, to a school on the east side which was mostly white. However, under policy IDFA it required that all students in Montgomery county who transfer schools to sit out for an academic year of all athletics. The policy was implemented too eliminate recruiting from Montgomery schools. In the past, the mostly white east side schools had always been better in athletics and received more funding for athletics.
