Article 91, UCMJ
Article 91 of the Uniform Code of Military Justice is in reference to Insubordinate conduct toward a warrant officer, a noncommissioned officer, or a petty officer. This Article is particularly pertinent in the area of disrespect, and refusal to obey.
What does this mean to the Army soldier? Due to the letter of the law, a soldier may not engage in the willful antagonizing, inciting, arguing, or assault of a warrant officer, noncommissioned officer, or a petty officer. Neither may a soldier disobey the order of said warrant officer, noncommissioned officer, or a petty officer.
How does this apply to my situation? The answer is that I have been disrespectful by action to a certain noncommissioned officer within my company. The circumstances of the situation are irrelevant under the uniform code of military justice. Though I was being treated with a great deal of disrespect and contempt in front of other fellow soldiers does not excuse my decision to walk away from the situation and sit down to cool off.
